TERMS OF SERVICE

These Terms of Service govern your access to and use of Adventure Strong Studio, an online subscription-based fitness and workout library operated by U Move 2 Improve LLC, DBA Adventure Strong Coaching (Bryan Maroney, ATC and KJ Maroney, Certified Pilates Instructor), based in Edwards, Colorado. By subscribing or using our services, you agree to be bound by these Terms.
 

1. Eligibility

You must be at least 18 years of age to subscribe to and use Adventure Strong Studio. By using our services, you represent and warrant that you meet this requirement.

2. Subscription and Payment

2.1 Subscription Fee

Adventure Strong Studio is offered as a monthly subscription at $89/month (or as otherwise listed at the time of purchase). Your subscription grants you access to the workout library during your active subscription period.

2.2 Billing

Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on file each month until you cancel.

2.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial months.

2.4 Refunds

All sales are final. We do not offer refunds except at our sole discretion or as required by applicable law. If you have a billing issue, please contact us at [email protected].

3. Health and Fitness Disclaimer

THE CONTENT PROVIDED ON ADVENTURE STRONG STUDIO IS FOR INFORMATIONAL AND FITNESS PURPOSES ONLY. IT IS NOT MEDICAL ADVICE AND DOES NOT REPLACE THE GUIDANCE OF A LICENSED PHYSICIAN, PHYSICAL THERAPIST, OR OTHER HEALTHCARE PROVIDER.
By participating in any workout, exercise program, or fitness content on our platform, you acknowledge and agree that:
  • You are voluntarily participating in physical activity and assume all associated risks
  • You have consulted or will consult with a qualified healthcare provider before beginning any fitness program, particularly if you have a known health condition, injury, or physical limitation
  • U Move 2 Improve LLC, DBA Adventure Strong Coaching, and its founders are not liable for any injury, illness, or adverse outcome resulting from use of the platform or its content

4. Assumption of Risk and Release of Liability

By using Adventure Strong Studio, you expressly assume all risks associated with physical exercise, including but not limited to: muscle strains, joint injuries, cardiovascular events, and other physical harm. You hereby release, waive, and discharge U Move 2 Improve LLC, DBA Adventure Strong Coaching, Bryan Maroney, KJ Maroney, and their affiliates from any and all claims, demands, or causes of action arising from your use of the platform or participation in any workout content.

5. Intellectual Property

All content on Adventure Strong Studio, including workout videos, written programming, images, logos, and brand assets, is the exclusive property of U Move 2 Improve LLC, DBA Adventure Strong Coaching. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Your subscription grants you a limited, personal, non-transferable license to access the content for your own personal, non-commercial use.

6. Prohibited Conduct

You agree not to:
  • Share your login credentials or allow others to access your account
  • Download, reproduce, or distribute any content from the platform
  • Use the platform for any unlawful or unauthorized purpose
  • Attempt to interfere with or disrupt the platform or its infrastructure
  • Misrepresent your identity or affiliation with any person or organization

7. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Service or engage in conduct that we determine is harmful to the platform, other users, or U Move 2 Improve LLC, DBA Adventure Strong Coaching. In such cases, no refund will be issued.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ADVENTURE STRONG COACHING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Eagle County, Colorado.

10. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Continued use of Adventure Strong Studio after changes are posted constitutes acceptance of the updated Terms.
